			<content:encoded><![CDATA[<p>On the 9th of December 2010, HM Treasury released the Overview of draft legislation for <a href="http://www.hm-treasury.gov.uk/d/financebill2011_draft_leg_overview.PDF">Finance Bill 2011 announcing legislation targeting schemes</a> to pay remuneration through Employee Benefit Trusts (EBTs).</p>
<p>The legislation will be introduced in the Finance Bill 2011, and become effective from 6 April 2011 onwards. The inclusion of anti-forestalling measures that became effective on the 9th December 2010 mean that from now payments of this type fall within the scope of the new measures.</p>
<p>The proposed legislation states that sums earmarked by trusts or other intermediaries will be treated as though it is a payment of income that is liable to PAYE tax.</p>
<p>Because of this ruling we believe that use of an EBT is no longer an option for your contractors.</p>
<p>If your contractors are using an <a href="http://www.hmrc.gov.uk/practitioners/macdonald-v-dextra.htm">EBT Company</a>, then they should immediately consider their options as they have now been made a<a href="http://rd.kpmg.co.uk/WhatWeDo/20053.htm"> target by HMRC</a> and with the wide ranging MSC legislation this could also prove risky for agencies who are continuing to use these services.</p>

<p>HMRC have issued a new <a title="HMRC Brief 50/09" href="http://www.hmrc.gov.uk/briefs/income-tax/brief5009.htm" target="_blank">press release</a> on 6 August regarding their concerns about intermediaries offering services to pay temporary workers (such as umbrella companies).<span id="more-997"></span></p>
<p><strong>Due Diligence</strong></p>
<p>They have also published a <a href="http://www.labourproviders.org.uk/files/HMRC_Leaflet_Due_Diligence_in_the_use_of_Labour_Providers_January_09.pdf" target="_blank">&#8216;Due Diligence</a>&#8216; guide for companies who use umbrella companies and other &#8216;labour provider&#8217; intermediaries.</p>
<p><strong>What agencies must do</strong></p>
<p>In the guide, HMRC claim that it is the agency&#8217;s duty to check the operation of any intermediaries they use to pay their workers or face losing &#8216;the right to reclaim vat&#8217;.</p>

<blockquote><p>&#8220;HMRC are obviously fed-up with employment businesses using non-compliant labour payment services &#8211; ignorance will no longer be a defence.  In this latest press release, they now expect employment businesses to complete a certain amount of due diligence or suffer the consequences:  &#8216;(agencies) will lose the right to recover vat&#8217;. &#8216; When you consider this in conjuction with the new construction clampdown, they obviously mean to focus more on agencies in the future.&#8221;  Redego</p></blockquote>

			<content:encoded><![CDATA[<p>HM Revenue &amp; Customs (HMRC) and HM Treasury&#8217;s joint consultation to review tax relief on travel expenses paid to workers by agencies and umbrella companies is now taking effect.</p>
<p>They were concerned by the mis-use of dispensations and scale-rate allowances and were considering new legislation. However, in their Pre-Budget Report, the Treasury confirmed that they would not be changing the rules, but would tighten compliance for <a href="http://www.redego.co.uk">umbrella companies</a> abusing dispensations.</p>
<p><strong>Beware of Dispensations and Scale Rates</strong></p>
<p>Many recruitment industry newswires were recently reporting this as &#8216;good&#8217; news, but for those contractors and agencies using umbrella companies that operate dispensations, the warning was in the small print:</p>
<blockquote><p>&#8220;However, in the light of evidence from the consultation confirming poor levels of compliance in this area HMRC will refocus its efforts to ensure that the current regime is properly applied&#8221;</p></blockquote>

<p>Undoubtedly, many umbrella companies will now attempt to jump on the bandwagon and drop their &#8216;No Receipts Required&#8217; offerings, but whether or not they have the compliance culture or technology to deliver remains to be seen.</p>
